I was always for the indoor smoking ban in the public square for public health reasons. I did not believe injuring unsuspecting patrons and employees was a property right.
The public has accepted that, nobody's rights have been trampled on, and the bar business is thriving.

Another argument the pro smokers presented was the "slippery slope" argument. That once we banned indoor tobacco smoking, other smoking related prohibitions would follow.. I poo-pood that . I was wrong ! . Now the do-gooders are going after vaping. Aside from looking really stupid, vaping is safe. Nicotine, while highly addictive, is not harmful. The theory that vaping could lead to tobacco use is not a valid reason for the government to restrict.

So much for the public health concerns.
If I own a bar and I want to allow smoking in my bar, my property rights are being trampled on if the state comes in and says I can't run my business and property as I see fit, especially since cigarettes are a legal product.

If a property/business owner didn't want smoking smokers simply wouldn't patronize that place, no big deal.

Now figure this out for public health - you can smoke in the casinos.
Don't plan on beating that dead horse any more.

I think tribal casinos are subject to tribal laws.
The casinos are regulated by the National Indian Gaming Assn and the Feds.

I don't think the feds (OSHA) regulates smoking.

I am aware of the state compact. As often as I am wrong, this time I must file this under the "me being lazy" with the responses. My original comment about casinos operating under tribal law stands.
